Public Offer Agreement

1. General provisions

Relations between the Seller and the Buyer are governed by the Civil Code of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan "On Protection of Consumer Rights", the Law "On Electronic Commerce" and other applicable legislation of the Republic of Uzbekistan.

The Seller may amend the terms of this Offer at any time. Amendments take effect upon publication of the new revision on the Website. The revision in force at the moment an Order is placed applies to that Order.

By placing an Order, the Buyer confirms having read this Offer, the Terms of Use and the Privacy Policy published on the Website.

2. Terms and definitions

• Website — the online store at madladscoffee.uz, including all of its pages and services.
• Goods — coffee, beverages, accessories and other products presented in the Website catalogue.
• Order — the Buyer's request to purchase selected Goods, placed through the Website.
• Seller — ARROWS CORNER LLC (ARROWS CORNER MChJ).
• Buyer — a legally capable individual or a legal entity that has placed an Order on the Website.

3. Subject of the agreement

The Seller undertakes to transfer the Goods into the Buyer's ownership, and the Buyer undertakes to accept the Goods and pay for them under the terms of this Offer.

Information about the Goods (description, composition, weight, price) is published on the Website. Product images are illustrative and may slightly differ from the actual appearance of the Goods without affecting their consumer properties.

4. Placing an order

The Buyer places an Order independently via the Website cart, providing their first and last name, contact phone number, delivery address and, where necessary, an e-mail address and order comment.

The Buyer is responsible for the accuracy of the data provided. The Seller is not liable for non-fulfilment of an Order caused by inaccurate or incomplete data supplied by the Buyer.

After an Order is placed, the Seller confirms it by phone, SMS or messenger. The Seller may decline to fulfil an Order if the Goods are unavailable, in which case any amounts paid are refunded to the Buyer.

5. Price and payment

Prices are listed on the Website in Uzbek soums and include applicable taxes. The Seller may change prices unilaterally; however, the price of an Order already paid for by the Buyer is not subject to change.

Payment is made by one of the methods available on the Website at checkout:

• UZCARD, HUMO, Visa and Mastercard bank cards via payment services;
• other electronic payment methods listed on the Website;
• cash or card upon receipt of the Goods, where available for the selected delivery region.

A fiscal receipt is provided to the Buyer in accordance with the legislation of the Republic of Uzbekistan.

6. Delivery and transfer of goods

Delivery is carried out within Tashkent and, where possible, to other regions of the Republic of Uzbekistan. Delivery methods, times and cost are indicated on the Website and/or agreed with the Buyer when the Order is confirmed.

Ownership of the Goods and the risk of their accidental loss or damage pass to the Buyer upon transfer of the Goods to the Buyer.

Upon receipt, the Buyer must check the integrity of the packaging and the conformity of the Goods with the Order. Claims regarding visible defects, quantity or completeness raised after acceptance are handled in accordance with applicable legislation.

7. Returns and exchanges

Coffee and other food products of proper quality are not subject to exchange or return under the legislation of the Republic of Uzbekistan.

If Goods of improper quality are received (defective, damaged or not matching the Order), the Buyer may, at their choice, demand replacement of the Goods or a refund. To do so, contact the Seller using the details in this Offer, attaching photos of the Goods and the Order number.

Refunds are made using the same payment method as the original payment, within the time limits established by the legislation of the Republic of Uzbekistan.

8. Liability of the parties

The parties are liable for non-fulfilment or improper fulfilment of their obligations under this Offer in accordance with the legislation of the Republic of Uzbekistan.

The Seller is not liable for damage caused to the Buyer as a result of improper use or storage of the Goods after their transfer to the Buyer.

9. Force majeure

The parties are released from liability for non-fulfilment of obligations caused by force majeure: natural disasters, fires, accidents, acts of state authorities and other circumstances beyond the parties' reasonable control. The time for performance is extended for the duration of such circumstances.

10. Dispute resolution

All disputes are resolved through negotiations. Claims must be sent to the Seller in writing to the e-mail address specified in the requisites; claims are reviewed within 15 (fifteen) calendar days of receipt.

If no agreement is reached, the dispute is referred to court in accordance with the legislation of the Republic of Uzbekistan.

11. Term of the offer

This Offer takes effect upon its publication on the Website and remains in force until withdrawn or replaced by a new revision by the Seller.
